Code of Professional Ethics - Florida Association of Residential Property Managers
Article 1
Duty to the Public
Professional Residential Property Managers shall not deny equal professional services to any persons for the reasons of race, color, religion, sex, handicap, familial status or national origin. We are pledged to the letter and spirit of the U.S. Policy for the achievement of Equal Housing Opportunity throughout our nation and state.
Article 2
Duty to Protect the Public
Professional Residential Property Managers shall protect the public against fraud, misrepresentation and unethical practices in the property management profession, through the furtherance of education and professional standards and practices.
Article 3
Confidentiality
Professional Residential Property Managers shall not disclose to a third party any confidential or proprietary information which would be damaging to a client or customer concerning the client’s or customer’s business or personal affairs without client or customer’s consent, unless such disclosure is compelled by applicable national or local laws, courts, and/or regulations.
Article 4
Accounting and Reporting
Professional Residential Property Managers shall maintain accurate financial and business records with documentation at all times. These records shall be reported to the client at regular intervals as agreed to with the client.
Article 5
Protection of Funds
Professional Residential Property Managers shall not commingle personal or company funds with the funds of a client or customer (or as prescribed by law) or use said funds for the benefit of another client or customer. All funds collected for others shall be held on their behalf in compliance with state law with full disclosure to those for whom the funds are held.
Article 6
Duty to the Client, Firm and/or Employer
Professional Residential Property Managers shall at all time exercise loyalty and act in the best interest of the client and the employer/broker or firm with whom the property manager is affiliated.
Article 7
Duty to Residents
Professional Residential Property Managers shall competently manage the property of a client with due regard for the rights, responsibilities and benefits of the residents and others lawfully on the property. This duty extends to the residents when they applying for, living in or vacating the managed residence.
Article 8
Compliance with Laws and Regulations
Professional Residential Property Managers shall use due diligence in the maintenance and management of the client’s property and all business practices with knowledge of and in compliance with applicable national, state and local laws and regulations. These laws and regulations include compliance with property safety and habitability requirements of the local jurisdiction in which the property is located.
Article 9
Competitive Relationships
Professional Residential Property Managers shall not make or otherwise encourage criticizing competitors or their business practices. Solicitation of a competitors current accounts is prohibited. This does not preclude general advertising announcements. Two or more competitors shall not conspire to commit improper acts relating to price fixing or anti-trust laws.
Article 10
Education and Professionalism
Professional Residential Property Managers shall strive to improve our profession through education and will share their knowledge with others for the benefit of all, within the property management industry.
